Shut up and lose - Dave Thackeray

I do a lot of talking, and after reading Stephen Rappaport?s excellent Listen First! book, I also try and squeeze in as much eartime as I can these days, too.

And it?s just as well, because what I?m hearing on repeat from so many business owners, fearful of the required change in mindset and application triggered by internet ubiquity, is finding an audience to match the commercial offering.

Most had just about figured their ideal customer. Now competition has grown exponentially and face-to-face transactions are on the slide, they?re obliged to seek ways of attracting customers through their digital doors.

And now we?re dealing with a whole new kettle of fish. Newspaper advertising worked for us in the 1990s, and we were cosying up to leaflet drops.

Now it?s electronic newsletters, blogs, anything to set ourselves ahead of the others vying for customer attention.

But there?s one secret weapon that isn?t secret any more. Not to you and me, any way ? and that?s all that matters right now.

What can?t you see that?s up a third?

Riddles aside, let?s shoot for Internet radio.

Consumption of all radio forms online is up 30% year on year, according to The Infinite Dial 2012: Navigating Digital Platforms, an annual ?state of the nation? report produced by Arbitron Inc and Edison Research.

It makes sense. Foisted upon by the digital melee, where information overload is an unsettling fact of life in 2012, people strive for constants, and traditional diversions.

They look for filters, content concierges, answers that aren?t cloaked or buried 15 pages deep.

A couple of days ago Stitcher, producer of the vaunted radio smartphone app, launched Smart Stations. Stitcher aggregates podcasts and selected radio stations broadcasting online.

Through its latest app release, Stitcher paints a picture of who you are based on the shows you thumb-up or thumb-down, share across social streams, and those you add to your own Favorite Channels. We?ve all tried blogging, and we all know the merits of long-term commitment to platforms where our customers of today and tomorrow like to hang out.

But so few of us have tried bringing our message to life using web radio, or ?podcasting?. And if you?re looking for a hot tip from me about tapping into the addictive appeal of ?theatre of the mind?, and virtually being there through sharing your business, philosophies and experiences with people who care, then I?d give it some serious thought.

Because it isn?t our products selling any more ? it?s our personalities. And it?s fear of expressing ourselves that?s keeping the shelves stacked.

On the importance of names. Or, "Are we at the hump or the hole?"

If you look at our recent GPS trajectory, you might think our navigator is, well, under the influence.

Chasing our tails, or chasing plankton?

But actually, our course is a planned path between 3 specific spots:

Da Base: Our home base for the past few days.
Da Hole: A location slightly south of Da Base, where the satellites showed chlorophyll levels looking a little low.
Da Hump: A spot slightly north of Da Base, where the satellites indicated chlorophyll levels were a little higher than the surrounding areas.

So we started at Da Base, went down to Da Hole, back to Da Base, up to Da Hump, back to Da Base, down to Da Hole, back to Da Base, and now we?re heading back to Da Hump. You get the idea. If you?re confused, it?s okay. So are a lot of people on board! A common question the past few days has been, ?Wait, where are we again??

The idea is to go to a place (like Da Base), and then poke around for a while, taking different measurements. With the help of satellites, we can see where there might be something interesting ? like low chlorophyll levels at Da Hole or high chlorophyll levels at Da Hump ? and we can go there to check out what?s happening by deploying instruments like the CTD, different profiling floats, nets and traps.

Right now we?re steaming north?up to Da Hump again. From there, we?ll go farther north, where there?s something the scientists are tentatively calling ?the promised land? where there seems to be a big bloom of something (hopefully Ehux!). We won?t know until we get there though.

Jaw-dropping switch saves 'Obamacare'

In his White House memoir, ?Courage and Consequence,? Karl Rove recalls being the lone non-lawyer among the group of George W. Bush aides who initially interviewed John Roberts for the Supreme Court in 2005. Rove asked Roberts to go back in history to name the justice whom he most revered. Roberts? answer, Robert Jackson, intrigued and reassured Rove. When appointed in 1941, Jackson was serving as Franklin Roosevelt?s attorney general and had been expected to be a pro-New Deal rubber-stamp on the court. But, as Rove put it, Jackson ?instead demonstrated a fidelity to the Constitution that Roberts admired.?

Thursday, in a jaw-dropping turnabout worthy of Justice Jackson, Roberts provided the swing vote in a 5-to-4 decision that upheld the constitutionality of almost all of Obamacare, the president?s signature legislative achievement. While an army of armchair court watchers expected Justice Anthony Kennedy to determine the fate of the Affordable Care Act (a recent Time cover called him ?The Decider?), it was Roberts who took his fidelity to the Constitution in an ideologically surprising direction. Kennedy voted with three other conservative justices to overturn the health insurance mandate at the heart of the law.

Constitutional law seminars and unlicensed political psychologists will spend years speculating about Roberts? motivations in joining the liberal bloc in probably the most important Supreme Court decision since Bush v. Gore in 2000. While we may wait decades to know for certain, it does seem plausible that Roberts may have been partly triggered by a desire to prevent the court from being seen as overtly political. Polls showing public respect for the Supreme Court at a quarter-century low reflect the growing view that the justices pursue partisan agendas.

One of the most important passages in Roberts? majority decision was the chief justice?s assertion: ?We do not consider whether the act embodied sound policies. That judgment is entrusted to the Nation?s elected leaders. We ask only whether Congress has the power under the Constitution to enact the challenge provisions.?

In short, if you want a national referendum on the health-care law, then the proper arena is the 2012 campaign?and not the inner sanctums of the Supreme Court.

The majority opinion in the health care case points up the inadequacy of the political clich?s used in the heat of an election year to describe the Supreme Court. Phrases like ?strict constructionist? and ?not making law from the bench? do not clarify complex Supreme Court opinions like Thursday?s ruling. Romney?s campaign website declares, ?As president, Mitt will nominate judges in the mold of Chief Justice Roberts and Justices Scalia, Thomas and Alito.? There?s only one problem with this formulation: Roberts went in one direction and Scalia, Thomas and Alito went in the opposite on the constitutionality of the health care bill.

Obama?s own ability at prophecy is limited, as well. In 2005, the former constitutional law professor declared in a Senate address that he was opposing Roberts? nomination to the Supreme Court because ?I ultimately have to give more weight to his deeds and overarching political philosophy ? than to the assuring words he provided me in our meeting.?

While Obama has sharply disagreed with major decisions of the Roberts Court (particularly the anything-goes Citizen United ruling on campaign finance), it is tempting to wonder if the president now feels that he misjudged the man who saved his legislative legacy.

It is almost part of the job description of a president that he will make, at least, one blunder when picking Supreme Court justices. Harry Truman called one of his nominees, Tom Clark, a ?damn fool from Texas.? When George H.W. Bush tapped New Hampshire jurist David Souter in 1990, the president never expected that he would be reinforcing the court?s liberal wing. Now it is Roberts who has refused to stay in his pre-determined ideological cubbyhole.

With four current justices over the age of 70, it is likely that whoever is elected president this November will get an opportunity to put his stamp on the Supreme Court. But the potential for Lucy-and-the-football surprises endures. About the only ways a president can achieve some measure of certainty about the court are either to nominate fire-breathing ideologues like Antonin Scalia or political cronies like Abe Fortas, who kept open a back channel to Lyndon Johnson during his brief tenure as a justice. But even the Scalia precedent no longer works, because anyone with a sharply articulated judicial philosophy probably could not make it through today?s hyper-partisan Senate.

As for the health care law, its major provisions remain on schedule to take effect in 2014. Even a President Romney may find it difficult to reverse history, as he would have to face down a filibuster threat by Senate Democrats to get a repeal bill through Congress. (There are, however, administrative gambits that Romney could use to eviscerate Obamacare if Congress proves balky.) That?s why the Supreme Court seemed like such a beguiling short cut for conservatives who loathe Obamacare.

It?s also why back in 2005 Karl Rove may have badly misinterpreted John Roberts? stated intention to be an independent jurist like Robert Jackson.

Don't Stop Writing Articles Because of Google Penguin | Sphinx Web ...

The Google Penguin algorithm update is nothing to worry about if you continue writing articles naturally, and without endless keyword repetition. The update has been designed to catch out those relying on ?black hat? web-spamming techniques to boost their rankings, and not those that have gained their ranking position fairly and honestly.

A search engine?s clients are those using it to find information, and Google is only trying to improve that service for its customers ? and by assisting the search engine to achieve this you can take a big step towards a good ranking. Google is not particularly targeting poor quality content here, although you will suffer if your page text is full of unnecessary instances of your keywords. What concerns Google is the source of the links back to your website, and the anchor text you use that people click onto reach your individual web pages.

So that?s it basically ? how to keep the Google Penguin algorithm update happy. To be more specific:

Your Web Page Content

Keep writing articles, but keep it natural and avoid keyword spamming. The Google Penguin update has been designed to detect what is known as webspam, a component of which is keyword stuffing ? trying to influence spider algorithms by excessive use of a keyword in an article or web page content.

You should work to a maximum of around 1% keyword density. The more discerning article directories apply a keyword limit to your submitted articles. Ezine Articles for example applies a 2% limit ? that includes similar terms, such as ?article writing,? ?writing articles,? and ?write articles? all being regarded as the same keyword; even ?articles? would be read as a keyword.

I would suggest using a keyword density of no more than 1%, if that. 2% should be regarded as a top figure.

Taking ?golf balls? as an example of a keyword you are using on a page in a golfing site, you would use the word ?golf? in terms such as ?golf shoes,? ?golf apparel? and many others. The algorithm has no idea of your intended keyword, so it will list what it believes appropriate from the semantics of your page. It will take ?golf? as a keyword and, if that exceeds a certain figure (nobody but Google knows what that is), your page is liable to be dropped a few places in the rankings for any of its keywords.

So write naturally and don?t worry about keyword density, other than to keep it low, although not so low that the main topic is lost. Forget numbers in your article writing, and write naturally and sensibly ? as if you were speaking to the person reading your article.

Your Anchor Text

Many people use the same anchor text in their links time after time. Mix it up: when you are writing your resource, box or creating in-text links that readers can click, it makes sense to use your primary keyword or phrase as the anchor text (the text that is highlighted as a link). Avoid the use of the same keyword or phrase all the time. If your website focuses on article writing or article marketing, avoid the temptation to keep repeating the word ?article? in the text.

You can employ a number of alternative words, such as dissertation, essay, passage, content, copy and so on.? Synonyms can often be difficult to find, particularly those meaning exactly the same in the same context, so if you are stuck for alternatives, check out an online thesaurus such as Thesaurus.com and you will find a whole host of them. You may lose the benefit of links back to your web pages if Google Penguin calculates your links as being over-repetitive (an algorithm is a mathematical formula and hence does not use human values).

Your Linking Strategy

The Google Penguin update looks for a diverse source for the links leading back to your web pages. Your search engine listing position will suffer if large numbers of backlinks come from the same website or from a recognized links farm. The same is true if your links are predominantly from poor quality web pages and pages not directly connected with the topic of those to which they link.

Mix your links between different sources, and also different types of source. For example, don?t have all your articles published on the same article directory. Make as sure as you can that the links leading back to your website (backlinks) are not all from the same source ? or even similar sources, but are mixed between different article and web directories, Squidoo lenses, forums, blogs, private web pages, etc.. Make sure your links come from multiple sources.

So, if you avoid excessive keyword repetition, vary your anchor text and mix the source of your backlinks up, you can kick the penguin in the rear end and tell it to get lost. Google?s purpose is to provide its clients with a good search experience ? the search engine is not particularly trying to punish you ? and the Google Penguin update is how it is achieving that. So keep writing

(AP) ? A U.S. Drug Enforcement Administration agent who killed a suspected drug trafficker during a raid in a remote region of Honduras was part of an aggressive new enforcement strategy that started in April and in little more than two months has caught more than half the number of illegal drug flights intercepted previously over 18 months.

The mission, called Operation Anvil, is run with six U.S. State Department helicopters that were moved from Guatemala to northern Honduras as well as a special team of DEA agents who work with Honduran police to move more quickly and pursue suspicious flights, according to a U.S. official in Honduras who couldn't be named for security reasons.

With the new operation, Honduran and U.S. drug agents follow every flight they detect of unknown origin and work with non-U.S. contract pilots that don't have the restrictions on rules of engagement that the U.S. military do.

The area of Brus Laguna, where the DEA says an agent shot a drug suspect as he was reaching for his gun Saturday, is part of the remote Mosquitia region that is dotted with clandestine airstrips and a vast network of rivers for carrying drugs to the coast.

Saturday's incident marked the first time that a DEA agent has killed someone in Central America since the agency began deploying specially trained agents several years ago to accompany local law enforcement personnel on all types of drug raids throughout the region, said DEA spokeswoman Dawn Dearden. Operation Anvil targets illicit flights.

A May 11 raid by Honduran police with DEA advisers also under Operation Anvil killed four people and wounded four others, whom locals said were innocent civilians traveling the river at night. Honduran and DEA officials have said the boat fired first and they were acting in self-defense. The DEA said none of its agents fired their guns in that incident.

Operation Anvil also netted cocaine shipments on May 6 in the Mosquitia and June 13 in Olancho state, totaling more three quarters of a ton of cocaine in about two months.

The Hondurans and the DEA have intercepted four flights under the operation in little more than two months. That compares with seven flights from mid-2010 to the end of 2011. The U.S. official said there are about 100 flights of suspicious origin coming into Honduras every year. Authorities are notified of them by U.S. Department of Defense air trackers nearly every couple days.

The weekend raid was a "great example of positive U.S.-Honduran cooperation," said U.S. Embassy spokesman Stephen Posivak in Tegucigalpa.

The official said the new operation could become a model for the region.

"It's because of what we're doing with the new assets," he said. "We have a dedicated team there 24-7... They're here for a period of time to see how effective they are."

But the aggressive tactics have come under fire from human rights groups and some political interests in Washington, especially since the May 11 attack.

The Committee of Relatives of the Disappeared in Honduras filed a complaint in May with the regional prosecutor in the Gracia a Dios region where the attack occurred, claiming human rights violations by Honduran and U.S. authorities. The group's investigation concluded that the dead and wounded were innocent civilians.

American University anthropology professor Adrienne Pine sent a letter signed by 40 Honduran scholars and former government officials, and supported by 300 academics in 29 countries, to President Barack Obama and Secretary of State Hillary Clinton earlier this month, demanding the U.S. cease support for the Honduran military and police.

"It's really troubling," Pine said Sunday. "It's absolutely not appropriate for U.S. law enforcement to be killing other people in other countries."

Operation Anvil is part of an overall increase in U.S. efforts in Honduras as drug trafficking and murder rates have spiked in the last year or so. With 82 murders per 100,000 people, the U.N. lists Honduras as the most dangerous country in the world. Its national police force is ripe with corruption, with some calling it one of country's main organized crime operations.

Since international crackdowns on drug trafficking began in Mexico and the Caribbean, Central America has become the crossing point for 84 percent of all U.S.-bound cocaine, according to statistics compiled by Joint Task Force-Bravo, a U.S. military installation in Comayagua, Honduras.

Non-commercial air and sea shipments of cocaine to Honduras have risen dramatically since 2006, when less than 10 percent of the U.S.-bound cocaine went through the country then. By 2011 the portion had jumped to more than 30 percent. Honduras has been the main landing point for such drug flights from South America since 2009.

The U.S. is nearly doubling its DEA personnel in Tegucigalpa from four to seven, the U.S. official said. Another eight to 10 agents are stationed in the north as part of the Foreign-deployed Advisory Support Teams, known as FAST, to train Hondurans and work on the State Department helicopters. The U.S. also recently established a full Narcotics Affairs Section in the embassy for the first time and is seeking its first extradition of an accused Honduran drug lord, Carlos Arnoldo Lobo, under a constitutional amendment passed by Honduras in January allowing its nationals to be extradited to the U.S.

The U.S. Embassy could not immediately say how much more is being spent in Honduras as a result, as a lot of the funds come from the Central America Regional Security Initiative, about $100 million a year for efforts across the region. The state helicopters, for example, are an official allocation to Guatemala even though they're now working in Honduras.

U.S. officials, including with the DEA, have done background checks and have trained 42 Honduran national police to work on drug-trafficking cases alongside DEA agents and U.S. military at Joint Task Force-Bravo.

Until April, the DEA and Hondurans had relied mainly on Joint Task Force-Bravo helicopters to chase illicit flights. But because of the rules of engagement for the U.S. military in Honduras, they could only fire back to protect themselves and their equipment and not the DEA or Honduran police who can come under fire in the field.

"These helicopters are different in that they're not U.S. pilots and they have the ability to fire in self-defense and in the protection of ground elements, where JTF Bravo, they're limited in rules of engagement," the U.S. official said.

The weekend's operation occurred around 12:30 a.m., when a U.S. agent and Honduran National Police arrested four suspects and seized 792 pounds (360 kilograms) of cocaine, Posivak said. He said six other people were arrested later on suspicion of aiding the smuggling operation.

The incident took place about 12 miles (20 kilometers) away from Ahuas, the site of the May 11 shooting, according to Ahuas mayor Lucio Baquedano. No one from the town was involved, Baquedano said, adding that at least 11 clandestine airstrips sit between Ahuas and Brus Laguna.

The operation was similar to the May 11 raid, according to another U.S. official who wasn't authorized to speak on the record. The previous operation involved four helicopters, two in the air and two that landed, and included Guatemalan contract pilots and Honduran police and military, with the DEA working as advisors.

The helicopters tracking the flight early Saturday saw about 40 people transporting drugs from the plane, the official said. They were intercepted by law enforcement about a half mile from the landing strip, where the seizure, arrests and shooting took place. Most of the 40 people scattered.

The DEA said it would not release the name of the agent who killed the suspect.

"During the operation, a fifth suspect attempted to engage the police team with a firearm and was shot by a DEA agent in self-defense," Posivak said. "The suspect subsequently died at the scene. There were no other injuries or fatalities."

Ministry of Security spokesman Ivan Mejia said Sunday that that the Honduran government has sent police, a judge, a prosecutor and medical examiners to the scene to investigate.

Investigations also continue into the May 11 Ahuas shooting, with confusion remaining about what actually happened.

Thread: Sharon's custom porch swing... - Family Woodworking

I bought the plans for Norm's porch swing. My wife didn't care for the size so I had to lengthen it and make it deeper. Break out the drawing board! She is visiting her Mom and wanted photos so she could show her the swing before Sharon returns home on Thursday. Did I mention....I miss her? It's been a long 3 1/2 weeks! So here it is in white oak.

The seat slats aren't attached yet. I will finish them separately from the frame and then attach them. You can see the pre-drilled holes in the seat slats. I will screw the slats on with stainless steel screws, plug the holes with oak dowels and sand smooth. Then apply finish to the plugs.

Notice the only hardware that will be visible are the 4 stainless steel bow eyes. Even their mounting hardware is recessed and the holes plugged with glued oak plugs.

All the joints are mortise and pinned tenons except....the two middle seat supports which are trapped between the lower back rail and the front seat rail.

There are 15 vertical back slats but only 5 are glued. The middle slat and two at each end. Even with slow setting glue, to glue all 15 would be nearly impossible for this old guy to do solo.

If my count is correct there are 50 mortise and tenon joints in this swing. I learned to dearly appreciate my General International hollow-chisel mortiser, a sharp hollow-mortise chisel and a sharp bit!

It was quite the learning experience!

(AP) ? The election of an Islamist president in Egypt is turning longstanding U.S. policy in the Mideast inside out: The Obama administration is relieved that the candidate representing three decades of close partnership with the United States lost.

The United States is now set to embrace a religious-based former opposition leader who does not share many U.S. goals, perhaps including the 30-year peace with Israel upon which U.S. policy in the region is based. The embrace won't be warm, and for the administration it will come with strings attached.

Still, the administration is calling the election of Mohammed Morsi on Sunday a milestone in the transition to democracy.

Morsi, from the formerly banned fundamentalist Muslim Brotherhood group, is the first Islamist president of Egypt. He defeated Ahmed Shafiq, ousted President Hosni Mubarak's last prime minister, in a tight race that deeply split the nation.

Now Morsi faces a daunting struggle for power with the still-dominant military rulers who took over after Mubarak was forced out in last year's Arab uprising.

The U.S. mostly had held the Muslim Brotherhood at arm's length in deference to Mubarak and long has eyed with suspicion the party's emerging positions on Israel, women's rights and religious freedom. The Muslim Brotherhood has said it would seek changes to Egypt's 1979 peace treaty with Israel without canceling it. Morsi said in his first televised speech that he would preserve Egypt's international accords, a reference to the peace deal with Israel.

Despite reservations, the Obama administration is relieved that Morsi won without unleashing a new wave of violence and unrest, and without provoking a military coup.

Morsi was popularly elected, and the freedom of the election is more important than who won it, U.S. officials said.

"We look forward to working together with President-elect Morsi and the government he forms to advance the many shared interests between Egypt and the United States," White House press secretary Jay Carney said Monday. "We judge individuals and parties that are elected in a democratic process by their actions, not by their religious affiliation."

"Our commitment to the revolution that began in Egypt ... is to a process that provides for a transition to democracy that is transparent," Carney said.

Deep concern that violence might erupt Sunday when the winner of the runoff was announced ebbed Monday as the United States, Israel and other nations assessed what the outcome portends.

"We want to see President-elect Morsi take steps to advance national unity, to uphold universal values, to respect the rights of all Egyptians, particularly women, minorities (and) Christians," State Department spokeswoman Victoria Nuland said.

U.S. officials said the administration is ready to send a senior official to Cairo to meet in person with Morsi and members of his government once his Cabinet is assembled and Washington is assured that the military has turned or will turn over power to the new president. Officials said full diplomatic recognition by the United States is likely once Morsi is inaugurated. The officials spoke on condition of anonymity because plans for Morsi's inauguration were not final.

The administration had expressed no public preference in advance of Sunday's announcement of the runoff results.

President Barack Obama made a point of calling both Morsi and the losing military-backed candidate on Sunday. He urged the military establishment to "play a role in Egyptian politics by supporting the democratic process and working to unify the Egyptian people," the White House said.

The military leadership has committed to handing over power at the end of this month.

"It's up to them to meet those commitments now going forward," Nuland said.

The United States wants Morsi to make a stronger statement of commitment to the peace deal signed at Camp David in 1979 but is settling so far for oblique references.

Nuland said the U.S. has heard nothing from Morsi to suggest that Egypt would rethink the treaty.

"Obviously we look forward to talking to President-elect Morsi and his government about Egypt's relationships in the neighborhood going forward, its upholding of all of its international obligations," Nuland said.

The peace treaty with Israel is the biggest unknown posed by the rise of the Muslim Brotherhood and more fundamentalist Islamic political parties in Egypt. The treaty is broadly unpopular in Egypt even though it is the bedrock for more than $1 billion in badly needed U.S. aid annually. Without an autocrat to keep the treaty in place by force, its long-term fate is uncertain.

Carney had a subtle warning to the Islamists that some U.S. support hinges on the treaty and Egypt's role as a peacemaker and bulwark among Arab nations. Washington was willing to overlook many of Mubarak's faults because he resisted pressure within Egypt to break the Camp David accords with Israel or loosen its alliance with the United States.

"We believe it is essential for the Egyptian government to continue to fulfill Egypt's role as a pillar of regional peace, security and stability," Carney said. "We will continue to emphasize this message with the new government and structure our engagement accordingly."

The extent of Morsi's power is not clear after the ruling military stripped most of the major powers from his post, but his victory speaks to the ebb of U.S. influence in the Mideast now and in the future, said Aaron David Miller, a Mideast scholar at the Wilson Center.

"For 50 years we dealt with authoritarian leaders" across the region, Miller said, because it served practical interests to do so. Bahrain and Saudi Arabia are about all that remain autocratic and strong U.S. allies, he noted.

"Dorothy, we're not in Kansas anymore," Miller said. "Our policies in the region are opposed by the vast majority of Arabs, and public opinion now plays a bigger role in governing. Our space is going to shrink."

Morgan Stanley's German head offers resignation: sources

FRANKFURT (Reuters) - The head of Morgan Stanley's German unit has offered to step down following an uproar over emails he reportedly exchanged with a regional politician, and the bank has not yet decided whether to accept his resignation, according to two people familiar with the matter.

The departure of Dirk Notheis would be a blow for the U.S. investment bank, which had come to rely heavily on him to deliver lucrative advisory roles in mergers and acquisitions, known as mandates.

The 44-year-old Notheis is one of Germany's best-connected dealmakers with close ties to Berlin, a fact that rivals say has helped Morgan Stanley snare mandates involving companies that are partially state-owned.

Emails published in the German newspapers Frankfurter Allgemeine Zeitung and Handelsblatt in the past week suggest Notheis gave strategic advice on moves by politicians in a way that has drawn sharp public criticism. The emails were not independently verified by Reuters.

In some of the emails, he appears to ask to keep German Chancellor Angela Merkel - whom he refers to as Mutti, German for "mom" - out of the loop until just before a controversial deal to nationalize an energy utility was completed in 2010.

Morgan Stanley declined to comment.

The correspondence highlights the delicate and often cozy nature of relationships among senior bankers and politicians negotiating multibillion-euro deals involving public-sector assets.

Earlier this year, senior JPMorgan Chase & Co banker Ian Hannam resigned following a high-profile clash with Britain's financial services watchdog over the level of disclosure during multibillion-euro deals.

Notheis got into hot water over his emails to Stefan Mappus, then the premier of Baden-Wuerttemberg, when the southern German state was seeking to buy a 45 percent stake in local utility provider EnBW from French utility EDF .

Notheis and Mappus are members of the Christian Democratic Union (CDU), the same political party as Angela Merkel.

Baden-Wuerttemberg eventually bought the EnBW stake in December 2010 for about 4.7 billion euros. But Baden-Wuerttemberg has since launched a probe into the deal and sued EDF, arguing they overpaid for the stake to the tune of 2 billion euros.

Morgan Stanley provided the emails to Baden-Wuerttemberg, as part of a probe into the deal.

Since the correspondence was published, Notheis has become a target of criticism among some Berlin politicians.

Frank Schaeffler, the parliamentary finance spokesman for Germany's Free Democratic Party said, "This is scandalous conduct by an investment bank. The morals and ethics of the entire industry are being damaged with actions like these."

Morgan Stanley has won some big mandates from Berlin under Notheis, who at one point took a break from banking to help raise campaign finance for Merkel's CDU party.

So far this year, Morgan Stanley ranks second in Europe, behind Goldman Sachs in terms of the value of merger-and-acquisitions deals in which it was involved, according to Thomson Reuters data. In Germany, the New York investment bank ranks second behind Deutsche Bank and ahead of Goldman.

Morgan Stanley was co-bookrunner for Commerzbank's 11 billion euro rights issue, adviser to Deutsche Telekom's aborted $39 billion sale of T-Mobile USA to AT&T and bookrunner for Deutsche Post DHL on a 750 million-euro exchangeable bond for state-controlled development bank KFW.

Germany retains a 15 percent equity stake in Deutsche Telekom, a 25 percent stake in Commerzbank and a 30.5 percent stake in Deutsche Post.

Emails from 2010 appear to show Notheis giving advice to Mappus about how to limit time for political debate about re-nationalizing EnBW.

"Call a confidential meeting at the state ministry with three politicians but without the supervisory board chairman, initially without giving a reason," said one of Notheis' emails to Mappus, as published in German daily Handelsblatt.

Merkel's assistance will be needed to help persuade the French to sell, and Mappus should meet with French premier Nicolas Sarkozy in person, Notheis said, adding, "Ask Mutti if she can arrange that," according to the published emails.

Because nationalization of assets is a tough sell among free-market politicians, Notheis advised Mappus to find external endorsement, according to the emails.

"Ideally find a renowned economist who thinks it's a good thing. It should be somebody who owes you a favor," according to the emails published in Handelsblatt.

He also advised Mappus not to get a second opinion. "You're going to get calls from numerous bankers. They will urge you to give them a mandate. You have to turn all of them down and tell them you are all set for advisers. And please pull this off. Otherwise it just causes sand in the gearbox and I really can't deal with that right now."

Notheis, who has been head of Morgan Stanley's German and Austrian operations, was named chief in February 2009, when he was 40 years old.

Football News: Cardiff City boss Malky Mackay tips old friend Brendan Rodgers to make big impact at Liverpool FC

CARDIFF CITY boss Malky Mackay insists his great friend Brendan Rodgers will revel in the pressure at Liverpool.

Rodgers quit the top job at Swansea City recently to take up the reigns at Anfield following the departure of Kenny Daglish.

At the age of just 39, the Northern Irishman finds himself in one of the most high profile posts in British football.

But Mackay, who is himself preparing for his second season in charge in the Welsh capital, believes Rodgers is ready for the challenge and more than equipped to make a success of things on Merseyside.

Mackay has been good friends with Rodgers since they were at Watford together.

After finishing his playing days with the Hornets, Mackay found himself caretaker manager at Vicarage Road after Aidy Boothroyd departed.

In November 2008 Rodgers was appointed Watford boss and kept Mackay on as his number two.

When Rodgers departed for an ill-fated spell at Reading he recommended Mackay as his successor in the Hornets? hot-seat handing the Scot his big break in football management.

Last summer Mackay joined Rodgers in Wales, but the Bluebirds? boss admits he is thrilled to see his friend move onwards and upwards.

?I?m absolutely delighted for Brendan. I?ve spoken to him regularly over the last couple of weeks.? said 40-year-old Mackay.

?He showed what he could do in the Premier League last season and now a club of higher standing has come in for him whilst his stock is high.

?He did a fantastic job at Swansea, that?s been well documented and it?s a very smart move by Liverpool.

?People might say he is young, but when you look at his reputation, at what he?s done then it is a move he has more than earned.?

Rodgers faces the task now of living up to the expectations of Liverpool and its supporters.

Anfield-legend Daglish was shown the door after Liverpool finished eighth last campaign and Rodgers? Reds will at least be expected to be challenging for a Champions League place this time around.

But Mackay believes Rodgers is strong minded enough to cope with the expectations.

?There?s not many clubs where there is more pressure than Liverpool,? said Mackay.

?But if you have ambition, which most managers do, and you want to play and manage at highest level then it's something you revel in.

?Brendan is the type who knows exactly what he wants to do when he goes in. He is a very focussed person.

?I?ve worked for him and he has a really good work ethic about him. He knows the way he wants to work and way he wants players to play.

?He will go in at Liverpool with exactly same work ethic and he will structure the club the way he wants it, I?ve no doubts that he will walk in and affect Liverpool from the start. Brendan will certainly not be overawed in the slightest that much is for certain.?

MIAMI (AP) - The players-only meeting called by Hanley Ramirez after Saturday's loss seemed to make a difference.

Mark Buehrle pitched effectively for seven innings to become the winningest pitcher in interleague play, John Buck hit a three-run homer and the Miami Marlins snapped a six-game losing streak with a 9-0 win over the Toronto Blue Jays on Sunday.

"It must have been that meeting," Buehrle said. "All of the guys that spoke up did good today."

Greg Dobbs had a two-run homer among his three hits for the Marlins, winners for just the third time in 18 games.

"It's great to see that especially when they have a players' meeting," Marlins manager Ozzie Guillen said. "I don't think it happened because of the meeting, but when you have a players' meeting and you act and play this way, that is something that is very positive. It's nice to see those guys having fun on the field."

Buehrle (6-8) gave up seven hits in winning his 25th interleague matchup, breaking a tie with Freddy Garcia. Buehrle struck out seven.

"I told them I wasn't a fan of having a meeting the day before I pitch because that puts more pressure on you," Buehrle joked.

Ramirez hit a two-run triple and scored on a sacrifice fly by Logan Morrison to cap the scoring for the Marlins. It was their second shutout of the season.

"This is what we needed," Ramirez said. "I told them (Saturday) that we needed to relax, go little by little, inning by inning, and not try to do too much."

Toronto starter Jesse Chavez (0-1) allowed six runs and seven hits in six innings while striking out six.

"I attacked the zone and kept away from the walks," Chavez said. "I settled in (after the second inning) and had that one hiccup in the sixth but other than that I did OK. It was just one of those things."

Miami opened the scoring in the second inning after Dobbs led off with a single and Omar Infante doubled. Scott Cousins drove in Dobbs with a base hit before Buck's three-run home run to center field, his sixth of the season.

Brett Lawrie doubled with two outs in the fifth and tried to score on a base hit to right by Colby Rasmus, but Giancarlo Stanton threw out Lawrie at home preserving a 4-0 lead.

Dobbs' two-run home run stretched the lead to 6-0. He also singled twice in his first two at-bats.

Ramirez's triple came off reliever Robert Coello, who hit Austin Kearns with a pitch and walked Jose Reyes setting the stage for Ramirez.

"It's not about one guy, but Hanley is in the middle of the lineup who is a big guy for us and hopefully he will remember that swing," Guillen said.

Rajai Davis and Rasmus each had two of the eight hits for the Blue Jays, who left eight on base. Toronto was shut out for the first time since a 3-0 loss to Baltimore on April 25.

"It was a disappointing way to end this series, yet it's a series win on the road and we have to regroup and get ready to go into Boston," Blue Jays manager John Farrell said.

HTC confirms it's closing offices, halting direct sales in Brazil

We don't have great news to share with Brazilian Android fans as the week winds to a close. After AndroidPit's initial word, we've since received extra confirmation from a spokesperson that HTC is closing its office in Brazil "after careful analysis of [its] business." The company wouldn't get any closer than that for reasoning, although the country's high tariffs on technology imports may play a part: they were high enough for Foxconn to open a Brazilian plant just so Apple could keep selling iPads and iPhones at comfortable prices, and HTC hasn't been making phones in Brazil for some time. There's also the matter of fighting to stay profitable in a market where Apple and Samsung are the only real money makers. HTC is vowing to keep up post-sale support, which we appreciate, but it's also stopping all direct sales in the process. As such, the only way you'll get a One S in Sao Paulo from now on is to go through an importer and take the added hit to the pocketbook.
